Terms and Conditions of Sale (TCS) - Pressonality
1. Object
1.1. These General Terms and Conditions of Sale (GTC) govern the terms and conditions of the sale of products offered by "Pressonality" on its website accessible at www.pressonality.com (hereinafter referred to as the "Site"). By placing an order on this Site, you fully and unconditionally accept these GTC accessible on www.pressonality.com
2. Products
2.1. "Pressonality" offers for sale press-on nails as well as other related nail beauty products.
2.2. Product Description:
The products are presented on the Website with detailed descriptions, including information about size, color, and usage instructions.
The images are provided for illustrative purposes and may show variations from the actual products.
2.3. Product Availability:
"Pressonality" strives to keep product availability information on the Site up to date. However, some products may not be available at the time of ordering. In such cases, the buyer will be notified and can choose an alternative or request a refund.
3. Prices and Payment
3.1. The prices displayed on the Site are in euros (€) and include the applicable French VAT.
3.2. Delivery fees are not included in the displayed price and will be indicated separately during the ordering process.
3.3. Payments can be made by credit card, PayPal, bank transfer, or any other payment method accepted by "Pressonality."
3.4. "Pressonality" reserves the right to change its prices at any time, but such changes will not affect orders already placed.
4. Order
4.1. To place an order, the buyer must follow the steps outlined on the Website, provide the required information, and accept these Terms and Conditions of Sale (CGV).
4.2. "Pressonality" reserves the right to refuse an order in case of non-payment, suspicion of fraud, or non-compliance with these GTC.
4.3. Once the order is confirmed, the buyer will receive a confirmation email containing the details of the order.
4.4. The order processing time is generally one week. Since all sets are hand-painted by one person, some orders may experience delays. For custom nail orders, the lead times are longer as the nails are initially designed using ProCreate, then approved by the client, painted, and then shipped.
5. Shipping and Delivery
5.1. "Pressonality" commits to ship products within the timeframes indicated on the Site, subject to stock availability.
5.2. Shipping costs and delivery times may vary depending on the destination and the delivery method chosen by the buyer.
5.3. In case of delivery delays, the buyer will be notified by "Pressonality" as soon as possible.
5.4. The buyer can choose from the following delivery options (at their own expense):
- Standard delivery
- Express delivery
6. Right of Withdrawal
6.1. In accordance with French law, the buyer has a period of 14 days from the receipt of the products to exercise their right of withdrawal, without having to justify reasons or pay penalties.
6.2. To exercise this right, the buyer must clearly notify "Pressonality" by email, attaching the order number/reference, and return the products in their original condition at their own expense.
6.2.1 Exclusions
In accordance with the provisions of articles L. 221-18 to L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for the following contracts:
- Supply of goods made to the consumer's specifications or clearly personalized;
- Supply of goods that have been unsealed by the consumer after delivery and that cannot be returned for reasons of hygiene or health protection.
6.3. "Pressonality" undertakes to refund the buyer within 14 days following the receipt of the returned products, subject to the condition of the return. In accordance with Article 6.2.1. of these GTC, returns of customized orders are not accepted.
6.4. In case of partial product returns, "Pressonality" will refund only the price of the returned products, excluding delivery charges.
6.5. Products must be returned in their original and complete condition (packaging, accessories, etc.) to allow for resale. In case of receiving opened, used, incomplete, damaged, or soiled products, "Pressonality" will not process any refund.
7. Guarantees and Liability
7.1. "Pressonality" guarantees that the products are in conformity with their description on the Site and free from hidden defects.
7.2. "Pressonality" cannot be held responsible for indirect or consequential damages resulting from the use of its products.
7.3. In case of a defective product, the buyer must contact "Pressonality" as soon as possible to request a solution, attaching at least three photos of the damaged or non-conforming elements.
8. Data Protection
8.1. "Pressonality" collects and processes the personal data of its customers in accordance with its Privacy Policy available on the Site.
8.2. The buyer can exercise their rights regarding data protection in accordance with French law.
9. Disputes
9.1. In case of dispute, the parties shall endeavor to find an amicable solution. Failing that, the French courts shall have jurisdiction to settle the dispute in accordance with the applicable French law.
9.2. In accordance with the provisions of the Consumer Code concerning amicable dispute resolution, "Pressonality" adheres to the Consumer Mediation Service whose contact details are as follows:

10. Modifications to the Terms and Conditions
10.1. "Pressonality" reserves the right to modify the GTC at any time. The new GTC will apply to orders placed after their publication on the Site.

12. Final Provisions
12.1. These Terms and Conditions constitute the entire agreement between the parties regarding the sale of the products and supersede any prior or contemporaneous agreements, whether written or oral.
12.2. If any provision of these Terms and Conditions is found to be invalid by a competent court, the remaining provisions shall remain in full force and effect.
12.3. The failure by "Pressonality" to exercise any of its rights under these GTC does not constitute a waiver of those rights.
12.4. The French version of the Terms and Conditions shall prevail in case of dispute or inconsistency between the translated versions in other languages.
